TERMO DE CIÊNCIA PARA ASSUMIR RISCOS E ACORDO DE RENÚNCIA AO DIREITO DE INDENIZAÇÃO E RESSARCIMENTO

INTRODUÇÃO
Você deve ler todo este TERMO DE CIÊNCIA PARA ASSUMIR RISCOS E ACORDO DE RENÚNCIA AO DIREITO DE INDENIZAÇÃO E RESSARCIMENTO IRONMAN® ("Termo") cuidadosamente antes de assinar. O participante adulto (com 18 anos ou mais) deve assinar este Termo. Em consideração aos serviços da Unlimited Sports (doravante "Organizador") em me permitir participar do IRONMAN® Brasil agendado para 2027 (daqui em diante "Evento"), eu, por livre e espontânea vontade, gozando de plena saúde, tanto física e mental, sem nenhum impedimento médico para a competição expressamente reconheço e concordo, com as seguintes formas:
CIÊNCIA E ASSUNÇÃO DOS RISCOS:
O evento pode acontecer em ambiente fechado ou ao ar livre e pode incluir, mas não está limitado a exercícios de aquecimento; natação competitiva, ciclismo e corrida, tanto na prática quanto no evento; demonstração (teste) de equipamentos; participação em clínicas, treinamento, demonstrações ou outros jogos e atividades; participação em qualquer atividade do evento; uso de qualquer equipamento, instalações; e viajar de avião, ônibus ou outro veículo para as atividades (o Evento e outras atividades referidas coletivamente neste Termo como "Atividades" ou "Atividade"). As atividades podem ser agendadas, obrigatórias ou opcionais, autorizadas e/ou conduzidas pelo Organizador, estruturadas ou não estruturadas e incluem tempo livre. Eu reconheço que os riscos, perigos e outros (referidos coletivamente neste Termo como "Riscos") das Atividades podem causar ferimentos, danos, morte ou outras perdas ao Participante ou a outros (terceiros).
A seguir descrevemos alguns, mas não todos, os Riscos assumidos pelo Participante ao participar do Evento ou Atividades:
- Saúde Física. O RISCO DE EXPOSIÇÃO A DOENÇAS TRANSMISSÍVEIS EM GERAL, INCLUINDO, MAS NÃO LIMITADO À COVID-19, EXISTE INERENTEMENTE EM QUALQUER LUGAR ONDE AS PESSOAS ESTEJAM PRESENTES, INCLUSIVE ANTES, DURANTE E/OU APÓS O EVENTO E AS ATIVIDADES. O risco de que a condição mental, física ou emocional de um Participante (incluindo qualquer uso ou abuso de álcool ou drogas prescritas ou não prescritas), seja revelada ou não revelada, conhecida ou desconhecida, combinada com a participação nessas atividades e riscos associados, possa resultar em ferimentos, danos, morte ou outras perdas. Embora o Organizador possa rever as informações médicas do Participante, submetidas no processo de registro, o Organizador não pode antecipar ou eliminar riscos ou complicações decorrentes da condição mental, física (incluindo o nível de aptidão física) ou emocional de um Participante.
- Atividades Competitivas ou Atléticas. Treinar, praticar ou competir em triatlo ou outros eventos e natação, ciclismo, corrida e outros condicionamentos associados envolve o uso frequente e repetitivo dos braços e pernas, extrema aptidão física e resistência, e empurrar os limites da velocidade e habilidades do Participante. O equipamento usado nas Atividades pode ser mal utilizado, ou pode quebrar, falhar ou funcionar incorretamente. O(s) Participante(s), coparticipante(s) e/ou terceiros podem agir negligentemente ou intencionalmente durante o Evento ou Atividades. O Organizador requer o uso de capacetes para atividades de ciclismo. Capacetes ou outros equipamentos de segurança podem prevenir ou diminuir ferimentos em alguns casos; entretanto, o uso de equipamentos de segurança não é uma garantia de segurança, e ferimentos podem ocorrer mesmo com o uso destes equipamentos.
- Ambiental. Os participantes podem estar sujeitos a: alta altitude ou terreno montanhoso; tempestades severas ou mau tempo, tais como relâmpagos, ventos fortes, chuva, granizo, neve e gelo; lagos rápidos ou profundos, oceanos ou outros corpos de água; correntes ou águas brancas; tempo extremamente quente ou frio; picadas, venenos e/ou animais portadores de doenças (incluindo vida marinha) ou insetos e outros perigos naturais ou causados pelo homem. Os perigos (tanto em terra como acima ou abaixo do nível da água) podem não ser marcados ou visíveis e o tempo é sempre imprevisível.
- Drone/UAVs. Veículos aéreos não tripulados, também conhecidos como "drones", podem ser usados no Evento para mídia ou outros fins, e há o risco de colisão e danos ou ferimentos.
- Atividade criminosa/terrorista. Existe um potencial risco de que um terceiro possa cometer atos criminosos ou terroristas. Antes, durante ou após o Evento ou Atividade, esses Riscos e outros podem causar: queda parcial ou no solo; colisão com objetos, pessoas ou o fundo de um corpo de água; desidratação; hiponatremia; afogamento; complicações cardíacas ou pulmonares; ossos quebrados; paralisia ou outra incapacidade permanente; trauma mental ou emocional; concussões; queimadura solar ou outros ferimentos, danos, morte ou perda. O Participante assume total responsabilidade pela escolha do equipamento apropriado e pelo ajuste e condição de uso do equipamento utilizado.
EU ENTENDO PERFEITAMENTE E ESTOU DE ACORDO QUE:
- Devo revisar todos os materiais recebidos, completar com exatidão e concordo com as informações, documentos e processos de registro, bem como com as regras e políticas. Obedeço a todas as regras e políticas, que incluem as Regras de Competição IRONMAN® com quaisquer exceções aplicáveis de qualquer Federação nacional aplicável, Federação internacional, Órgão sancionador de provas e as Regras de Competição da União Internacional de Triatlo; revisar todas as informações incluídas no guia de informações do atleta específico do Evento e na sessão de briefing do atleta específico do Evento; e todas as leis de trânsito;
- Aceito ser submetido e cumprir as Regras IRONMAN® Antidoping, incluindo, sem limitação, todas as políticas, procedimentos e/ou outras regras adotadas pela UNLIMITED SPORTS. Também concordo em estar vinculado ao Código Mundial Antidoping e às Normas Internacionais associadas, conforme emitidas pela Agência Brasileira Antidoping e Agência Mundial Antidoping. Reconheço que também posso estar vinculado às regras de qualquer federação nacional aplicável, federação internacional, órgão sancionador de raças ou organização antidoping com autoridade sobre mim;
- Entendo que nem o Organizador nem seu pessoal, representantes, voluntários, contratados ou qualquer pessoa associada ao Organizador supervisionarão o Participante a qualquer momento. O Participante concorda em ser o único responsável pelo bem-estar do Participante em todos os momentos;
- Minha aceitação final e participação no Evento dependerá do recebimento e revisão pelo Organizador de todas as informações e formulários necessários, incluindo o presente Termo;
- Antes de participar das Atividades, poderei inspecionar o percurso da corrida, instalações, equipamentos e áreas a serem utilizadas;
- Eu represento e garanto que a participação nas Atividades requer extrema aptidão e resistência, que sou o único responsável pelo meu condicionamento e aptidão antes, durante e depois das Atividades, e que eu, em conjunto com meus provedores médicos, sou responsável por determinar se as Atividades são apropriadas para mim antes de participar;
- Reconheço que a inscrição na Divisão Para Open (Physically Challenged Open Division) é obrigatoriamente submetida à análise técnica da IRONMAN Group / World Triathlon Corporation (WTC), autoridade internacional exclusivamente competente para deliberar sobre a elegibilidade paradesportiva conforme as IRONMAN Competition Rules (Seção 8.01(a)) e as World Triathlon Para Sport Classification Rules. Estou ciente de que a condição legal de pessoa com deficiência reconhecida pelo ordenamento brasileiro (Lei nº 13.146/2015 - Lei Brasileira de Inclusão) não implica elegibilidade automática à referida categoria competitiva. Reconheço, ainda, que a análise técnica poderá resultar em realocação da minha inscrição para a categoria Amadores - Faixa Etária (Age Group), sem qualquer alteração no valor pago no ato da inscrição;
- Estou ciente da existência de risco inerente de exposição a doenças transmissíveis em geral, incluindo mas não limitado à COVID-19, em qualquer local onde pessoas estejam presentes, e assumo voluntariamente tais riscos ao participar do Evento e das Atividades. Ao visitar qualquer local relacionado ao Evento, comprometo-me a seguir todas as instruções de saúde e segurança que me forem transmitidas pelo Organizador ou pelas autoridades competentes;
- As informações fornecidas neste Termo não são exaustivas, outras atividades desconhecidas ou não previstas, riscos inerentes ou outros riscos e resultados podem existir, e o Organizador não pode garantir minha segurança ou eliminar qualquer um dos riscos. Entendo que posso e devo consultar os representantes do Organizador se tiver mais perguntas sobre as Atividades ou os Riscos;
- Estou participando de forma voluntária do Evento e Atividades com conhecimento dos Riscos e de acordo com este Termo, que foi negociado de forma justa e honesta. Assim, assumo e aceito total responsabilidade por mim mesmo, pelos Riscos inerentes e outros (tanto conhecidos como desconhecidos) das Atividades, e por qualquer lesão, dano, ou outra perda que possa sofrer, que resulte em incapacidade temporária ou permanente ou morte. Esses riscos podem ser ocasionados por mim, por um coparticipante, por um espectador, por um voluntário e/ou por uma terceira parte por negligência passiva ou ativa ou outra má conduta.
- Estou ciente das regras de arbitragem que têm total autoridade para decidir sobre os resultados finais e a desclassificação de atletas. As regras estão disponíveis no site oficial do evento www.ironmanbrasil.com.br
- Estou ciente que toda e qualquer disputa sobre os resultados finais e a desclassificação de atleta devem ser remetidas ao tribunal desportivo competente.
RENÚNCIA AO DIREITO DE INDENIZAÇÃO OU RESSARCIMENTO
POR FAVOR, LEIA ATENTAMENTE ESTA SEÇÃO DE RENÚNCIA AO DIREITO DE INDENIZAÇÃO OU RESSARCIMENTO, POIS ESTA CONTÉM UMA SUBMISSÃO DE CERTOS DIREITOS LEGAIS, AOS QUAIS EU RECONHEÇO E CONCORDO COM O SEGUINTE:
- ACATAR COM ESTE TERMO PARA EXONERAR DE QUALQUER RESPONSABILIDADE AQUI DELIMITADA E NÃO PROCESSAR o Organizador, em especial a Unlimited Sports e a WTC e qualquer federação e/ou órgão sancionador de competição aplicável, patrocinadores de eventos, organizadores de eventos, promotores de eventos, produtores de eventos, diretores de corridas, oficiais de eventos, funcionários de eventos, anunciantes, administradores, empreiteiros, fornecedores, voluntários e todos os proprietários de propriedades e órgãos governamentais federais, estaduais, municipais e/ou órgãos municipais (individual e coletivamente referidas neste Termo como as "Partes Exoneradas"), com respeito a toda e qualquer reivindicação, responsabilidade, processos ou despesas por qualquer dano, morte, perda de propriedade, propriedade roubada, propriedade descartada, ou outras perdas de qualquer forma relacionadas com os Riscos listados acima ou minha inscrição ou participação no Evento e Atividades, incluindo sem limitação o uso de qualquer equipamento, instalações, seja qual for a causa. CONCORDO AQUI EM RENUNCIAR A TODAS AS REIVINDICAÇÕES QUE POSSA TER CONTRA AS PARTES EXONERADAS E CONCORDO QUE NEM EU, NEM MEUS HERDEIROS, CESSIONÁRIOS OU BENEFICIÁRIOS FARÁ UMA REIVINDICAÇÃO CONTRA AS PARTES EXONERADAS POR QUALQUER DANO, MORTE OU OUTRA PERDA QUE POSSA SOFRER;
- O PARTICIPANTE OBRIGA-SE A PROTEGER, DEFENDER E INDENIZAR AS PARTES EXONERADAS COM RESPEITO A REIVINDICAÇÕES APRESENTADAS PELO PRÓPRIO PARTICIPANTE EM RAZÃO DE CONDUTA A ELE IMPUTÁVEL, EXCLUÍDAS AS REIVINDICAÇÕES APRESENTADAS POR CÔNJUGE, FAMILIARES, COPARTICIPANTES OU TERCEIROS, SALVO SE DECORRENTES DE ATO CULPOSO OU DOLOSO COMPROVADO DO PRÓPRIO PARTICIPANTE. ESTA SEÇÃO DE LIBERAÇÃO E INDENIZAÇÃO INCLUI, MAS NÃO SE LIMITA A REIVINDICAÇÕES POR DANOS PESSOAIS OU MORTE, DANOS MATERIAIS, PERDA DE CONSÓRCIO, QUEBRA DE TERMO OU QUALQUER OUTRA REIVINDICAÇÃO IMPUTÁVEL AO PRÓPRIO PARTICIPANTE.
DISPOSIÇÕES DIVERSAS
- ACORDO PARA ARBITRAR (adequado à legislação brasileira). Quando permitido pela legislação aplicável, controvérsias decorrentes do presente Termo, da inscrição ou da participação nas Atividades poderão ser submetidas a arbitragem, na forma do regulamento oficial do Evento. Nas hipóteses em que a arbitragem obrigatória for vedada pela legislação brasileira, notadamente quanto a Participantes domiciliados no Brasil e consumidores para os fins da Lei nº 8.078/1990, o Participante poderá optar pela via judicial no foro do seu domicílio, nos termos do art. 101, I, do Código de Defesa do Consumidor.
- RESOLUÇÃO INDIVIDUALIZADA DE DISPUTAS. Preferencialmente, e sempre que compatível com a legislação aplicável, as disputas serão resolvidas de forma individualizada, ressalvadas as hipóteses em que a legislação brasileira assegurar ao Participante o direito à tutela coletiva, nos termos dos arts. 81 e 82 do Código de Defesa do Consumidor e demais normas processuais aplicáveis.
- Com relação ao meu relacionamento com a Unlimited Sports e/ou WTC (Organizador), este Termo prevalecerá sobre quaisquer outras formas ou contratos que eu possa assinar para outras partes que não o Organizador em conexão com as Atividades.
- Se eu utilizar qualquer dos serviços de bicicleta fornecidos ou disponibilizados em conexão com o Evento, pagarei o custo de tais serviços mediante o recebimento da(s) fatura(s) aplicável(eis).
- Na medida em que houver situações em que eu forneça ao Organizador qualquer de meus bens pessoais a serem mantidos, poderá haver ocasiões em que tais bens pessoais não poderão ser devolvidos a mim. Renuncio a todos os direitos sobre tais bens e concordo expressamente com toda e qualquer ação que o Organizador possa tomar com respeito a tais bens, incluindo alienação.
- Em nenhuma hipótese eu posso, sem o consentimento prévio por escrito do Organizador: (a) utilizar qualquer propriedade intelectual do Organizador ou WTC, ou (b) vender, comercializar, distribuir ou produzir quaisquer produtos, eventos, mercadorias, websites ou serviços que tenham a marca IRONMAN®, 70.3®, ou marca usando qualquer logotipo, nome, IP do Evento ou do Organizador/WTC (incluindo sem limitação a palavra "IRON" ou qualquer tradução estrangeira como prefixo ou componente de qualquer raça, evento, nome comercial, marca registrada, ou marca de qualquer tipo, em cada caso de qualquer forma relacionada a triatlo ou esporte de resistência).
- Autorizo o pessoal do Organizador, representantes ou contratados a inspecionar qualquer equipamento que eu utilize em conexão com o Evento, incluindo inspeção de bicicletas para ocultação de qualquer motor ou mecanismo de aceleração artificial.
- Autorizo o pessoal do Organizador, seus representantes ou contratados a conduzir tais atividades de inspeção de segurança em saúde pública. Enquanto estiver participando do Evento, concordo em cumprir com quaisquer instruções de saúde pública e/ou segurança do pessoal do Organizador; polícia; ou autoridades governamentais ou de saúde.
- Autorizo o pessoal do Organizador, representantes, contratados ou outro pessoal médico a obter ou fornecer cuidados médicos para mim, a me transportar para uma instalação médica e a fornecer tratamento (incluindo evacuação, hospitalização, transfusões de sangue, cirurgia e medicamentos) que eles considerem necessário para minha saúde. Eu concordo em pagar todos os custos associados a esse cuidado e transporte.
- O Organizador reserva-se o direito, a seu exclusivo critério, de excluir qualquer participante das Atividades, negar ou revogar a entrada de qualquer participante a qualquer momento, e/ou desqualificar o participante do Evento. Se eu for desclassificado por qualquer motivo, concordo que sou responsável por todos os custos da partida antecipada, seja por motivos médicos, desclassificação, emergências pessoais ou outros.
- Reconheço e concordo que o Organizador ou WTC, a seu exclusivo critério (seja por razões de segurança, motivos legais, ou qualquer outro motivo), pode: (a) a qualquer momento, com ou sem aviso prévio, alterar ou modificar o percurso da corrida, distâncias, rotas, elevação, ascensões, nível de dificuldade, ou qualquer outro aspecto do percurso da corrida ou do Evento; ou (b) atrasar ou cancelar o Evento se acreditar que as condições são inseguras ou inadequadas. Se o percurso da corrida ou Evento for alterado, modificado, atrasado ou cancelado por qualquer razão, incluindo atos da natureza, atos de terrorismo, incêndio, ameaça, dificuldade de trabalho, insurreição, guerra, desastre público, riscos à saúde pública, enchente, ou qualquer outra causa fora do controle da Organizadora, não haverá reembolso da taxa de entrada. Na hipótese de cancelamento ou reprogramação do Evento por caso fortuito ou força maior, o Organizador poderá conceder crédito para edição futura correspondente à taxa de inscrição paga, na forma da política de créditos vigente à época.
- PROTEÇÃO DE DADOS PESSOAIS (LGPD). Autorizo, nos termos da Lei nº 13.709/2018 (Lei Geral de Proteção de Dados - LGPD), o tratamento dos meus dados pessoais e sensíveis pelo Organizador e pela WTC, incluindo dados de saúde (para análise de aptidão e eventual elegibilidade paradesportiva) e dados biométricos faciais (para validação de identidade em check-in, retirada de kit e demais controles operacionais), exclusivamente para as finalidades relacionadas ao Evento. Autorizo, ainda, a transferência internacional de tais dados para a IRONMAN Group (WTC), sediada nos Estados Unidos da América, nos termos dos arts. 33 a 36 da LGPD. Os dados serão descartados após a conclusão do Evento, ressalvadas as hipóteses de guarda obrigatória previstas em lei.
- Concedo ao Organizador Unlimited Sports, à WTC e seus respectivos afiliados, designados, cessionários e patrocinadores o direito e permissão para fotografar, filmar, gravar e/ou de outra forma capturar (incluindo o uso de tecnologia de reconhecimento facial) em qualquer mídia o nome, imagem, voz, declaração escrita, fotografia e/ou semelhança visual de mim e/ou de meus familiares (coletivamente "Imagens"), com direito a sub-licenciamento, durante as atividades ou de outra forma, sem compensação, para uso para qualquer finalidade e em qualquer mídia em todo o mundo em perpetuidade.
- O Organizador e/ou a WTC poderá ceder este Termo a outras entidades ou indivíduos a qualquer momento, e qualquer cessão concederá aos Cessionários todos os direitos e proteções concedidos neste Termo.
- Entendo que também posso ser obrigado a assinar uma versão deste Termo no local. Se eu assinar este Termo tanto online como no local, concordo que a versão física (on-site) deste Termo será vinculativa e de controle.
- Este Termo é válido e efetivo em relação à inscrição ou participação do Participante no Evento ou Atividades a partir da data de assinatura até a conclusão de todas as atividades, e permanecerá em pleno vigor e efeito após a conclusão de todas as atividades.
- Este Termo deve ser interpretado e aplicado na medida máxima permitida por lei. Se qualquer parte deste Termo for considerada ilegal ou inexequível, não afetará a aplicabilidade das demais disposições.
Li cuidadosamente, compreendo e concordo em assinar voluntariamente este Termo e entendo que, ao fazê-lo, estou firmando um contrato legalmente vinculativo com o Organizador Unlimited Sports. Reconheço que este Termo será efetivo e legalmente vinculante para mim, meu cônjuge, filhos e outros herdeiros de minha família.
ACKNOWLEDGMENT AND ASSUMPTION OF RISKS & RELEASE AND INDEMNITY AGREEMENT

INTRODUCTION
You must read this entire ACKNOWLEDGMENT AND ASSUMPTION OF RISKS & RELEASE AND INDEMNITY AGREEMENT IRONMAN® (hereinafter the "Agreement") carefully before signing. The adult participant (18 years of age or older) shall sign this Agreement. In consideration of the services of Unlimited Sports (hereinafter the "Organizer") in allowing me to participate in the 2027 IRONMAN® Brazil scheduled event (hereinafter the "Event"), I, willingly and expressly, enjoying full physical and mental health, with no medical impediment to participate in the Event, acknowledge and agree as follows:
ACKNOWLEDGMENT AND ASSUMPTION OF RISKS
The Event may take place indoors or outdoors and may include, but is not limited to, warm-up exercises; competitive swimming, cycling and running, both in practice and during the Event; demonstration (testing) of equipment; participation in clinics, training, demonstrations or other games and activities; participation in any Event activity; use of any equipment and facilities; and travel by airplane, bus or other vehicle to the activities (the Event and any other activities are collectively referred to in this Agreement as the "Activities" or "Activity"). The Activities may be scheduled, mandatory or optional, authorized and/or conducted by the Organizer, structured or unstructured, and include free time. I acknowledge that the risks, hazards and other dangers (collectively referred to in this Agreement as the "Risks") of the Activities may cause injuries, damages, death or other losses to the Participant or to others (third parties).
The following describes some, but not all, of the Risks assumed by the Participant when participating in the Event or Activities:
- Physical Health. THE RISK OF EXPOSURE TO COMMUNICABLE DISEASES IN GENERAL, INCLUDING BUT NOT LIMITED TO COVID-19, IS INHERENTLY PRESENT WHEREVER PEOPLE ARE GATHERED, INCLUDING BEFORE, DURING AND/OR AFTER THE EVENT AND THE ACTIVITIES. The risk that the Participant's mental, physical or emotional condition (including any use or abuse of alcohol or prescribed or non-prescribed drugs), whether disclosed or undisclosed, known or unknown, combined with participation in these Activities and their associated risks, may result in injury, damage, death or other losses. Although the Organizer may review the Participant's medical information submitted during the registration process, the Organizer cannot anticipate or eliminate the risks or complications arising from the Participant's mental, physical (including physical fitness level) or emotional condition.
- Competitive or Athletic Activities. Training, practicing or competing in triathlon or other events, and swimming, cycling, running and other associated conditioning, involve the frequent and repetitive use of arms and legs, extreme physical fitness and endurance, and pushing the limits of the Participant's speed and abilities. Equipment used in the Activities may be misused, or may break, fail or malfunction. The Participant(s), co-participant(s) and/or third parties may act negligently or intentionally during the Event or Activities. The Organizer requires the use of helmets for cycling activities. Helmets or other safety equipment may prevent or diminish injuries in some cases; however, the use of safety equipment does not guarantee safety, and injuries may occur even with the use of such equipment.
- Environmental. Participants may be subject to: high altitude or mountainous terrain; severe storms or bad weather, such as lightning, strong winds, rain, hail, snow and ice; fast or deep lakes, oceans or other bodies of water; currents or whitewater; extremely hot or cold weather; bites, poisons and/or disease-carrying animals (including marine life) or insects, and other natural or human-made hazards. Hazards (both on land and above or below water level) may not be marked or visible, and the weather is always unpredictable.
- Drone/UAVs. Unmanned aerial vehicles, also known as "drones", may be used at the Event for media or other purposes, and there is a risk of collision and resulting damage or injuries.
- Criminal/Terrorist Activity. There is a potential risk that a third party may commit criminal or terrorist acts. Before, during or after the Event or Activity, these and other Risks may cause: partial fall or fall to the ground; collision with objects, people or the bottom of a body of water; dehydration; hyponatremia; drowning; cardiac or pulmonary complications; broken bones; paralysis or other permanent disability; mental or emotional trauma; concussions; sunburn or other injuries, damages, death or loss. The Participant assumes full responsibility for the choice of appropriate equipment and for the fit and condition of the equipment used.
I FULLY UNDERSTAND AND AGREE THAT:
- I shall review all materials received, complete them accurately and agree with the information, documents and registration processes, as well as with the rules and policies. I shall comply with all rules and policies, including the IRONMAN® Competition Rules, with any applicable exceptions from any applicable national Federation, international Federation, sanctioning body and the International Triathlon Union Competition Rules; review all information included in the Event-specific athlete information guide and in the Event-specific athlete briefing session; and all traffic laws;
- I accept to submit to and comply with the IRONMAN® Anti-Doping Rules, including, without limitation, all policies, procedures and/or other rules adopted by UNLIMITED SPORTS. I also agree to be bound by the World Anti-Doping Code and its associated International Standards, as issued by the Brazilian Anti-Doping Agency and the World Anti-Doping Agency. I acknowledge that I may also be bound by the rules of any applicable national federation, international federation, race sanctioning body, or anti-doping organization with authority over me;
- I understand that neither the Organizer nor its personnel, representatives, volunteers, contractors or any person associated with the Organizer will supervise the Participant at any time. The Participant agrees to be solely responsible for the Participant's well-being at all times;
- My final acceptance and participation in the Event will depend upon the Organizer's receipt and review of all necessary information and forms, including this Agreement;
- Before participating in the Activities, I may inspect the race course, facilities, equipment and areas to be used;
- I represent and warrant that participation in the Activities requires extreme fitness and endurance, that I am solely responsible for my conditioning and fitness before, during and after the Activities, and that I, together with my medical providers, am responsible for determining whether the Activities are appropriate for me before participating;
- I acknowledge that registration in the Para Open Division (Physically Challenged Open Division) is mandatorily subject to technical review by IRONMAN Group / World Triathlon Corporation (WTC), the international authority exclusively competent to rule on para-sport eligibility pursuant to the IRONMAN Competition Rules (Section 8.01(a)) and the World Triathlon Para Sport Classification Rules. I am aware that the legal status of person with a disability recognized under Brazilian law (Federal Law No. 13,146/2015 - Brazilian Inclusion Act) does not automatically imply eligibility for the referred competitive category. I further acknowledge that the technical review may result in the relocation of my registration to the Amateur - Age Group category, without any change to the amount paid at the time of registration;
- I am aware of the inherent risk of exposure to communicable diseases in general, including but not limited to COVID-19, in any place where people are gathered, and I voluntarily assume such risks by participating in the Event and Activities. When visiting any location related to the Event, I undertake to follow all health and safety instructions provided to me by the Organizer or by the competent authorities;
- The information provided in this Agreement is not exhaustive. Other unknown or unforeseen activities, inherent risks, or other risks and outcomes may exist, and the Organizer cannot guarantee my safety or eliminate any of the risks. I understand that I may and should consult with the Organizer's representatives if I have further questions about the Activities or the Risks;
- I am voluntarily participating in the Event and Activities with knowledge of the Risks and in accordance with this Agreement, which has been negotiated fairly and honestly. I therefore assume and accept full responsibility for myself, for the inherent and other Risks (both known and unknown) of the Activities, and for any injury, damage, or other loss I may suffer, resulting in temporary or permanent disability or death. Such risks may be caused by me, by a co-participant, by a spectator, by a volunteer and/or by a third party, through passive or active negligence or other misconduct.
- I am aware of the arbitration rules that have full authority to decide on final results and disqualification of athletes. The rules are available on the official Event website www.ironmanbrasil.com.br
- I am aware that any and all disputes regarding final results and disqualification of athletes shall be referred to the competent sports tribunal.
RELEASE AND INDEMNITY
PLEASE READ CAREFULLY THIS RELEASE AND INDEMNITY SECTION, AS IT CONTAINS A SUBMISSION OF CERTAIN LEGAL RIGHTS, WHICH I ACKNOWLEDGE AND AGREE TO AS FOLLOWS:
- TO COMPLY WITH THIS AGREEMENT TO RELEASE FROM ANY LIABILITY HEREIN DELIMITED AND NOT TO SUE the Organizer, in particular Unlimited Sports and WTC and any applicable federation and/or competition sanctioning body, event sponsors, event organizers, event promoters, event producers, race directors, event officials, event staff, advertisers, administrators, contractors, suppliers, volunteers, and all property owners and federal, state, municipal and/or local governmental bodies (individually and collectively referred to in this Agreement as the "Released Parties"), with respect to any and all claims, liability, lawsuits or expenses for any damage, death, loss of property, stolen property, discarded property, or other losses in any way related to the Risks listed above or my registration or participation in the Event and Activities, including without limitation the use of any equipment or facilities, regardless of the cause. I HEREBY AGREE TO WAIVE ALL CLAIMS THAT I MAY HAVE AGAINST THE RELEASED PARTIES AND I AGREE THAT NEITHER I, NOR MY HEIRS, ASSIGNS OR BENEFICIARIES, WILL MAKE A CLAIM AGAINST THE RELEASED PARTIES FOR ANY DAMAGE, DEATH OR OTHER LOSS I MAY SUFFER;
- THE PARTICIPANT UNDERTAKES TO PROTECT, DEFEND AND INDEMNIFY THE RELEASED PARTIES WITH RESPECT TO CLAIMS BROUGHT BY THE PARTICIPANT DUE TO CONDUCT ATTRIBUTABLE TO THE PARTICIPANT, EXCLUDING CLAIMS BROUGHT BY SPOUSE, FAMILY MEMBERS, CO-PARTICIPANTS OR THIRD PARTIES, EXCEPT WHEN ARISING FROM PROVEN WILLFUL OR NEGLIGENT CONDUCT BY THE PARTICIPANT. THIS RELEASE AND INDEMNITY SECTION INCLUDES, BUT IS NOT LIMITED TO, CLAIMS FOR PERSONAL INJURY OR DEATH, PROPERTY DAMAGE, LOSS OF CONSORTIUM, BREACH OF AGREEMENT, OR ANY OTHER CLAIM ATTRIBUTABLE TO THE PARTICIPANT.
MISCELLANEOUS PROVISIONS
- AGREEMENT TO ARBITRATE (adapted to Brazilian law). Whenever permitted by applicable law, disputes arising from this Agreement, from registration or from participation in the Activities may be submitted to arbitration, in accordance with the Event's official regulations. In the cases in which mandatory arbitration is forbidden by Brazilian law, notably regarding Participants domiciled in Brazil and considered consumers for the purposes of Federal Law No. 8,078/1990, the Participant may choose the judicial route in the venue of the Participant's domicile, pursuant to Article 101, I, of the Brazilian Consumer Protection Code.
- INDIVIDUALIZED DISPUTE RESOLUTION. Preferably, and whenever compatible with applicable law, disputes shall be resolved on an individual basis, except in the cases in which Brazilian law grants the Participant the right to collective protection, pursuant to Articles 81 and 82 of the Brazilian Consumer Protection Code and other applicable procedural rules.
- With respect to my relationship with Unlimited Sports and/or WTC (Organizer), this Agreement shall prevail over any other forms or contracts that I may sign for parties other than the Organizer in connection with the Activities.
- If I use any of the bicycle services provided or made available in connection with the Event, I shall pay the cost of such services upon receipt of the applicable invoice(s).
- To the extent that there are situations in which I provide the Organizer with any of my personal belongings to be kept, there may be occasions on which such personal belongings cannot be returned to me. I waive all rights to such belongings and expressly agree to any and all actions the Organizer may take with respect to such belongings, including their disposal.
- Under no circumstances may I, without the Organizer's prior written consent: (a) use any intellectual property of the Organizer or WTC; or (b) sell, market, distribute or produce any products, events, merchandise, websites or services bearing the IRONMAN®, 70.3® mark, or a mark using any logo, name, Event IP or Organizer/WTC IP (including without limitation the word "IRON" or any foreign translation thereof as a prefix or component of any race, event, trade name, trademark, or mark of any kind, in each case in any way related to triathlon or endurance sports).
- I authorize the Organizer's personnel, representatives or contractors to inspect any equipment I use in connection with the Event, including inspection of bicycles for concealment of any engine or artificial acceleration mechanism.
- I authorize the Organizer's personnel, representatives or contractors to conduct public health safety inspection activities. While participating in the Event, I agree to comply with any public health and/or safety instructions from the Organizer's personnel; police; or governmental or health authorities.
- I authorize the Organizer's personnel, representatives, contractors or other medical personnel to obtain or provide medical care for me, to transport me to a medical facility, and to provide treatment (including evacuation, hospitalization, blood transfusions, surgery and medication) that they deem necessary for my health. I agree to pay all costs associated with such care and transportation.
- The Organizer reserves the right, at its sole discretion, to exclude any Participant from the Activities, to deny or revoke the entry of any Participant at any time, and/or to disqualify the Participant from the Event. If I am disqualified for any reason, I agree that I am responsible for all costs of early departure, whether due to medical reasons, disqualification, personal emergencies or otherwise.
- I acknowledge and agree that the Organizer or WTC, at its sole discretion (whether for safety reasons, legal reasons, or any other reason), may: (a) at any time, with or without prior notice, alter or modify the race course, distances, routes, elevation, ascents, level of difficulty, or any other aspect of the race course or the Event; or (b) delay or cancel the Event if it believes conditions are unsafe or inadequate. If the race course or Event is altered, modified, delayed or cancelled for any reason, including acts of nature, acts of terrorism, fire, threat, labor difficulty, insurrection, war, public disaster, public health risks, flood, or any other cause beyond the Organizer's control, there will be no refund of the entry fee. In the event of cancellation or rescheduling of the Event due to act of God or force majeure, the Organizer may grant credit for a future edition corresponding to the registration fee paid, in accordance with the credit policy in force at the time.
- PERSONAL DATA PROTECTION (LGPD). I authorize, pursuant to Federal Law No. 13,709/2018 (Brazilian General Data Protection Law - LGPD), the processing of my personal and sensitive data by the Organizer and by WTC, including health data (for purposes of fitness analysis and any para-sport eligibility assessment) and facial biometric data (for identity validation at check-in, kit pickup and other operational controls), exclusively for the purposes related to the Event. I further authorize the international transfer of such data to IRONMAN Group (WTC), headquartered in the United States of America, pursuant to Articles 33 to 36 of the LGPD. The data will be discarded upon completion of the Event, except for the retention hypotheses provided for by law.
- I grant the Organizer Unlimited Sports, WTC and their respective affiliates, designees, assignees and sponsors the right and permission to photograph, film, record and/or otherwise capture (including the use of facial recognition technology) in any media the name, image, voice, written statement, photograph and/or visual likeness of me and/or of my family members (collectively, "Images"), with the right of sub-licensing, during the Activities or otherwise, without compensation, for use for any purpose and in any media worldwide in perpetuity.
- The Organizer and/or WTC may assign this Agreement to other entities or individuals at any time, and any such assignment shall grant the Assignees all rights and protections granted under this Agreement.
- I understand that I may also be required to sign an on-site version of this Agreement. If I sign this Agreement both online and on-site, I agree that the physical (on-site) version of this Agreement shall be binding and controlling.
- This Agreement is valid and effective in relation to the Participant's registration or participation in the Event or Activities from the date of signature until the conclusion of all activities, and shall remain in full force and effect after the conclusion of all activities.
- This Agreement shall be interpreted and applied to the maximum extent permitted by law. If any part of this Agreement is deemed illegal or unenforceable, it shall not affect the enforceability of the remaining provisions.
I have carefully read, understand and agree to voluntarily sign this Agreement, and I understand that, by doing so, I am entering into a legally binding contract with the Organizer Unlimited Sports. I acknowledge that this Agreement shall be effective and legally binding upon me, my spouse, children and other family heirs.

Declaro que:

1. Estarei presente neste evento por minha livre e espontânea vontade, isentando de quaisquer responsabilidades os ORGANIZADORES e as empresas envolvidas, em meu nome e de meus herdeiros;

2. Isento organizadores e empresas envolvidas no evento de qualquer responsabilidade sobre objetos deixados por mim em guarda-volumes, chapelaria ou locais indicados pela organização do evento;

3. Estou ciente que o valor pago não será devolvido em caso de cancelamento ou não participação no evento, bem como não são aceitas substituições / troca de participantes;

4. Estou de acordo com cobrança de valor adicional da TAXA DE SERVIÇO para cada novo ingresso / inscrição adquirido(a) no sistema, caso haja a respectiva taxa;

5. Estou ciente que ingressos / inscrições podem encerrar-se a qualquer momento, sob definição da empresa organizadora;

6. Confirmo que, para garantir meu ingresso / inscrição é necessário efetuar o pagamento do valor total do mesmo, e que, caso não seja pago ou pago em valor divergente (ainda que em valor maior ao devido), o ingresso/inscrição será(ão) cancelado(s) automaticamente no sistema e a vaga liberada;

7. É de minha responsabilidade obter todas as informações sobre o evento, tais como: data, local e horário;

8. Estou fisica e mentalmente apto a participar deste evento, nas condições propostas pela organização;

9. Autorizo a utilização por parte do organizador, patrocinadores e Ticket Sports de qualquer dado, fotografia, filme ou outra gravação contendo imagens de minha participação neste evento, em qualquer mídia seja impressa ou eletrônica, incluindo na Internet, para qualquer fim e por tempo indeterminado;

10. Autorizo recebimento de e-mails, SMS e WhatsApp, bem como qualquer meio digital de comunicação, do ORGANIZADOR e Ticket Sports e seus parceiros divulgando informações, notícias e serviços;

11. Na realização do cadastro, compra de ingressos ou inscrições para terceiros, tenho a autorização deste(s) participante(s), me responsabilizo pela legitimidade de dados fornecidos e garanto que o mesmo tem total ciência desta declaração e do respectivo REGULAMENTO do evento;

12. Estou ciente que, caso seja autorizado qualquer tipo de estorno, poderá ser cobrada a taxa e/ou custos do processo de reembolso;

13. Estou totalmente ciente e concordo com o REGULAMENTO ou REGRAS GERAIS deste Evento, bem como do Termo de Uso e Política de Privacidade da plataforma Ticket Sports.
